Who In The Church? Privacy Policy

The Who In The Church? website and services are provided by Who In The Church?, LLC (“Who In The Church?”). This Privacy Policy govern your (“Your” or “You”) access to and use of the services and features available on Who In The Church?’s website located at www.WhoInTheChurch?.com and all related sub-domains, tools, and services or through downloadable applications that Who In The Church? makes available (“Website”) to You, including without limitation Who In The Church?’s platform for connecting homeowners and customers with Christian businesses and service providers (collectively, “Services”). This Privacy Policy incorporates by reference the Terms of Service. Access to the Website, use of Services, and referrals to Customers or Contractors are subject to This Privacy Policy and the Who In The Church? Terms of Service.

Who In The Church? is an online marketplace to enable connections between individuals or companies seeking business-related services (“Customers”) through the completion of specific Work, repairs, or services (“Work”) and businesses, service providers, or contractors that are Christian owned and run, and which have also confirmed that they are operated in compliance with a statement of faith (“Contractors”), as specified by Who In The Church? from time to time. The Contractors make available their professional skills in the completion of Work, as requested by Customers, in exchange for reasonable compensation upon the completion, to the extent agreed upon by Contractors and Customers, as discussed below. Customers and Contractors together are collectively referred to as "Users" and each individually as a “User.”

1. Informational Requirement
You may use this Website as a member of the general public who is not a Customer or a Contractor without volunteering personally identifiable information. If You are a Customer or a Contractor, You are required to release personally identifiable information in order to register with Who In The Church? and to contract with other Users for Work. The information that You must disclose in order to register may include, without limitation, Your name and address, e-mail address, telephone number, and such other information as determined by Who In The Church? from time to time (“User Information”), which will be stored under Your “Account(s)” page.

If You are registering as a Contractor, Who In The Church? will also ask You to provide a statement of faith, a verification of church membership, professional and trade history and qualification, business information, or other relevant qualifications You may have that will assist You in completing Work. If You are registering as a Customer, Who In The Church? will ask You to provide Your User Information, along with information about Your Work needs, Your household or company profile, and other information as determined by Who In The Church? from time to time to help Who In The Church? understand the Work You may request through Who In The Church?.

By accepting these Terms of Service, You agree and acknowledge that You will provide accurate, complete, and up to date information as requested on the screens that collect information from You. You further agree and acknowledge that Your submission of personally identifiable information to the Website is voluntary and entirely at Your own risk.

2. Rights in Your Data
You hereby represent and warrant to Who In The Church? that (i) any User Information or other information relating to soliciting, offering, providing, or completing Work, as submitted to Who In The Church? or the Website, including without limitation User Information, is true and correct and (ii) You have the right to provide any and all of the User Information or other information listed in Your Profile and to provide access to information acquired through Your Background Check (as defined below) (collectively, “Your Information”) for the purposes of these Terms of Service. You hereby grant to Who In The Church? a perpetual, irrevocable, royalty-free, worldwide right and license to copy, display, make derivative works of and otherwise use Your Information for any purpose, subject in all respects to Who In The Church?’s Privacy Policy. If You object to Your Information being used in a manner permitted by these Terms of Service or the Privacy Policy, please do not use the Website or our Services. Upon termination of Your Credentials for any reason, You may no longer have access to any of Your Information that You provided to the Website.

3. Background Checks
If You are a Contactor, Who In The Church? has the right, but not the obligation, to verify whether the information displayed in Your Account is accurate. You hereby grant to Who In The Church? the right to conduct background checks to confirm the accuracy of any User Information that is available on Your Account including without limitation Your name and address, e-mail address, telephone number, statement of faith, Church? membership, billing information, professional experience and certifications, any other of Your qualifications, Your credit score and a criminal background check of You (collectively, “Background Checks”).
CONTRACTOR HEREBY GRANTS TO WHO IN THE CHURCH? THE RIGHT TO CONDUCT A CREDIT CHECK AND A CRIMINAL BACKGROUND CHECK BY REGISTERING WITH THE WEBSITE UPON RECEIVING YOUR EXPLICIT WRITTEN OR ELECTRONIC CONSENT. CONTRACTOR AGREES AND ACKNOWLEDGES THAT WHO IN THE CHURCH? RESERVES THE RIGHT TO DISTRIBUTE RESULTING INFORMATION, AS SET FORTH IN THIS PARAGRAPH, TO INTERESTED CUSTOMERS POTENTIALLY SEEKING WORK FROM YOU. For the avoidance of doubt, Who In The Church? is under no obligation to conduct Background Checks on Contractor, but Who In The Church? may conduct a Background Check when a Contractor first registers with Who In The Church? or from time to time thereafter as long as Contractor maintains an account with Who In The Church?. THE RELEASE OF A CONTRACTOR’S BACKGROUND CHECK INFORMATION REQUIRES THE EXPRESS WRITTEN OR ELECTRONIC CONSENT OF THE CONTRACTOR WHOSE INFORMATION IS BEING RELEASED. CUSTOMER SHALL NOT RELEASE SUCH BACKGROUND CHECK INFORMATION WITHOUT SUCH CONSENT.

4. Confidential Information
Customer, Contractor, and Who In The Church? (each a “Party,” and collectively, “Parties”) agree and acknowledge that each Party shall keep strictly confidential any information that a Party (“Recipient”) accesses on the Website or is otherwise made available to the Party by another Party (“Disclosing Party”) related to Services or Work requested or performed, including without limitation information concerning the business, operations, trade secrets or other proprietary information of any Party (“Confidential Information”), using at least the same degree of care that such Party would use to protect his, her or its own confidential or proprietary information of a similar nature but in no event less than reasonable care. Each Party agrees to not use the Confidential Information except for the purposes set forth in these Terms of Service including for the purposes of any relationship between Customer and Contractor and to not disclose or disseminate any Confidential Information to any person at any time, except to those of such Party’s directors, officers, employees, accountants, attorneys, advisers and agents whose duties reasonably require them to have access to such Confidential Information and are bound by obligations of confidentiality at least as stringent as those herein.

“Confidential Information” shall not include any information: (a) that is generally available to the public or becomes generally available without the Recipient or Recipient’s representatives violating these Terms of Service; (b) which is lawfully received by Recipient on a non-confidential basis from a third party that is not itself under any obligation of confidentiality or nondisclosure; (c) that can be shown to have been independently developed by Recipient without reference to the Confidential Information of any other Party; and (d) that is in Recipient’s possession at the time of disclosure by the Disclosing Party, unless such information was previously disclosed pursuant to a confidentiality obligation or hereunder.

Who In The Church? may require You to agree to a non-disclosure agreement prior to sharing certain other information with You. Any such non-disclosure agreement between You and Who In The Church? shall apply to information shared in connection with the Website or Services, unless otherwise provided in such non-disclosure agreement. Customer and Contractor may agree to a separate agreement between Customer and Contractor with obligations regarding the protection and disclosure of any Confidential Information, and the provisions of any such Agreement shall override this Section, as between those parties.
